Welcome to KILS Pottery. These Terms & Conditions apply to the use of the KILS website and to purchases made through our online store. By using this website or placing an order with KILS, you agree to these Terms & Conditions. Please read them together with our Shipping Policy and Refund & Returns Policy.

KILS Pottery is a small-batch pottery studio based in the Western Cape, South Africa, and is operated as a sole proprietorship.

KILS pottery is made by hand in small batches. As a result, individual pieces may vary slightly in form, dimensions, glaze, colour, surface, speckling and other characteristics.

These natural variations are part of the handmade ceramic process and mean that no two pieces are necessarily identical.

Where several pieces are available under the same product listing, the piece received may differ subtly from the piece shown in the photographs. One-of-a-kind pieces will generally be represented by photographs of the individual piece being offered for sale.

We make every reasonable effort to ensure that product photographs, descriptions, dimensions and other information displayed on the website are accurate. Colours and finishes may nevertheless appear slightly different depending on lighting, photography and the screen or device being used.

KILS works in limited, seasonal collections rather than maintaining continuous stock.

Products are subject to availability, and adding an item to your cart does not reserve or guarantee that item until an order has been successfully completed.

While we take reasonable steps to keep stock information accurate, an item may occasionally become unavailable due to a stock discrepancy or other error. If this affects an order that has already been paid for, KILS will contact the customer and arrange an appropriate resolution, including a refund where necessary.

Once a collection or product is sold out, it may not be reproduced or restocked.

All prices displayed on the KILS website are in South African Rand (ZAR) unless otherwise stated.

The price applicable to an order is the price displayed and confirmed during checkout at the time the order is placed.

Shipping charges, where applicable, will be shown separately during checkout.

KILS reserves the right to change product prices at any time. Price changes will not retrospectively affect orders that have already been successfully placed and paid for.

If an obvious pricing or website error occurs, KILS reserves the right to correct the error. Where the error affects an order that has already been placed, we will contact the customer to resolve the matter appropriately.

When placing an order, you are responsible for providing complete and accurate information, including your name, contact details and delivery address.

Submitting an order does not necessarily mean that it has been accepted. An order is considered confirmed once payment has been successfully completed and the order has been accepted by KILS.

KILS reserves the right to decline or cancel an order where reasonably necessary, including in cases of stock errors, payment problems, suspected fraudulent activity, obvious pricing errors or circumstances that prevent us from fulfilling the order.

Where KILS cancels an order after payment has been received, the relevant amount will be refunded.

Payment for online orders must be made using the payment methods made available during checkout.

Payments may be processed securely by a third-party payment service provider. KILS does not require customers to provide payment-card details directly to us where payment is completed through the payment provider’s secure payment environment.

An order will not be treated as paid until successful payment has been confirmed.

KILS currently delivers within South Africa only.

Please allow 2–4 business days for an order to be processed before dispatch. Delivery times after dispatch vary according to destination and the delivery service used.

Shipping costs are calculated at checkout based on the order and delivery destination.

Free delivery is available for orders delivered within Hermanus and Vermont.

KILS currently offers door-to-door delivery to physical South African addresses only. Full details regarding processing, delivery, damaged parcels and delivery information are available in our Shipping Policy, which forms part of these Terms & Conditions.

Returns, refunds, faulty products and items damaged during delivery are handled in accordance with the KILS Refund & Returns Policy.

Change-of-mind returns may be requested within 7 days of receiving an eligible order, subject to the conditions set out in that policy.

Items damaged during delivery should be reported to KILS within 48 hours of delivery, together with the requested photographs and order information.

Nothing in these Terms & Conditions or our other policies is intended to exclude or limit rights available to customers under applicable South African consumer law.

Customers should follow any care or usage information provided with a product or displayed on the KILS website.

As ceramic products can be fragile, reasonable care should be taken when handling and using them.

KILS cannot be held responsible for damage caused by misuse, accidental damage, improper handling or failure to follow reasonable product-care instructions, subject to applicable law.

Unless otherwise stated, the content of the KILS website—including photographs, product designs, written content, branding, graphics and the KILS name and logo—is owned by or licensed to KILS and is protected by applicable intellectual-property law.

Website content may not be copied, reproduced, distributed, commercially used or presented as another person’s work without prior written permission from KILS, except where permitted by law.

You agree not to use the KILS website for unlawful, fraudulent or harmful purposes or in a way that could interfere with the operation or security of the website.

While we take reasonable care to maintain accurate and functional website content, we cannot guarantee that the website will always be available without interruption or technical error.

KILS may update, modify or temporarily suspend parts of the website where reasonably necessary.

To the extent permitted by applicable law, KILS will not be liable for indirect or consequential loss arising from the use of the website or products where such liability may lawfully be limited.

Nothing in these Terms & Conditions excludes or limits liability or customer rights that cannot legally be excluded or limited under South African law.

Personal information supplied through the KILS website will be used for legitimate business purposes such as processing orders, arranging delivery, communicating with customers and operating the online store.

Personal information will be handled in accordance with applicable South African privacy legislation.

Where third-party providers are used to facilitate services such as payments or delivery, relevant information may be shared with those providers to the extent reasonably necessary to provide the service.

KILS may update these Terms & Conditions from time to time to reflect changes to the website, our services, business practices or applicable requirements.

The version published on the website at the time of an order will apply to that transaction, subject to applicable law.

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the website or a transaction with KILS will be dealt with in accordance with applicable South African law.
